Welcome to the website of Fight Club Academy and Recovery Lab (the “Organization,” “we,” “us,” or “our”), an Arizona nonprofit corporation recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code. By accessing or using this website (the “Site”), any mobile applications, or related services (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the Services.

2. Use of the Site

The Site provides information about our mission, programs, events, and opportunities to support our work through donations, volunteering, or other means. You may use the Services only for lawful purposes and in accordance with these Terms.

4. Donations and Payments

All donations made through the Site are voluntary and non-refundable unless otherwise stated. Donations are tax-deductible to the fullest extent allowed by law. We use reasonable efforts to process donations securely but are not responsible for any errors or delays. By making a donation, you represent that you have the legal right to use the payment method provided. We reserve the right to refuse or cancel donations at our discretion.

5. User Content and Contributions

If you submit content, comments, photos, or other materials (“User Content”), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, and display it in connection with our mission. You represent that your User Content does not infringe third-party rights and is not unlawful or harmful. We may remove any User Content at our discretion.

The Site may contain links to third-party websites. We do not endorse or control these sites and are not responsible for their content or practices. Your use of third-party sites is at your own risk.

7. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE ORGANIZATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND VOLUNTEERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING ANY CLAIM (IF ANY).

9. Indemnification

You agree to indemnify, defend, and hold harmless the Organization and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of your use of the Site, violation of these Terms, or infringement of any rights.

10. Changes to Terms

We may update these Terms at any time. We will post the revised Terms with a new “Last Updated” date. Your continued use of the Site after changes constitutes acceptance of the new Terms.

11. Termination

We reserve the right to terminate or suspend your access to the Services at any time, with or without cause, and without notice.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. You waive any objections to venue or jurisdiction in such courts.

13. Miscellaneous

If any provision of these Terms is held invalid, the remainder shall continue in full force. Our failure to enforce any right does not waive it. These Terms constitute the entire agreement between you and us regarding the Site.
No agency, partnership, or joint venture is created by these Terms.
